Comply With CAN SPAM

Tip#5 in our Blog Series: CAN-SPAM compliance!

CAN SPAM stands for the “Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003” and was signed into law by President George W. Bush. This act governs the sending of commercial email and is enforced by the Federal Trade Commission.

CAN SPAM requires commercial email to adhere to the following requirements:1 

  • Don’t use false or misleading header information.
  • Don’t use deceptive subject lines.
  • Identify the message as an ad.
  • Tell recipients where you’re located.
  • Tell recipients how to opt out of receiving future email from you.
  • Honor opt-out requests promptly.
  • Monitor what others are doing on your behalf.

Noncompliance with CAN SPAM regulations can be costly. However, the good news is that when you partner with Infocore, we make sure that every email you send is 100% compliant 100% of the time.

Unsubscribe Link is Essential

Even though we take care of CAN SPAM requirements in general, it’s important that you don’t forget to provide a working unsubscribe link in your HTML file. As we mentioned in Tip #1: Make a Content Checklist, providing an unsubscribe link is not only necessary to comply with CAN SPAM, but it’s also an important part of email etiquette. You will keep your potential customers happy, keep your lists clean, and keep spam complaints to a minimum if you provide a clear and easily accessible unsubscribe link.

Also, to comply with CAN SPAM regulations, our data partners will add their own footer to your email that includes information about their permission-based email programs and unsubscribe information. You may request this footer file in advance so that your development team can incorporate it into your HTML file. Many clients choose to do so in order to make the footer more aesthetically pleasing and to keep the design consistent with the rest of the email. If this is not done, the footer can look out of place and possibly draw attention away from the creative that you’ve so carefully crafted.
